Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and OC Study ("we," "us," or "our") governing your access to and use of the OC Study platform, website, and related services (collectively, the "Service"). By registering for an account, subscribing, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not use the Service.
2. The Service
OC Study is an adaptive SAT and ACT preparation platform that provides students with personalized practice questions, AI-powered study plans, progress tracking, and score prediction tools. The Service is accessible to registered students and their parent or guardian accounts.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes that affect their subscription.
3. Eligibility & Age Requirements
Users 13 and older
You must be at least 13 years old to create an account on OC Study. Users who are 13–17 years of age ("minors") must have a parent or guardian review these Terms and provide consent before the student account is activated.
Users under 13
Important: We do not knowingly collect personal information from children under 13 without verified parental consent. If a student is under 13, a parent or guardian must register and manage the account. See Section 5 for details.
If we learn that we have inadvertently collected personal information from a child under 13 without parental consent, we will delete that information promptly. Parents may contact us at privacy@ocstudy.com to report or request deletion.
4. Account Registration
To use the Service, you must create an account and provide accurate, current, and complete information including your name, email address, date of birth, and grade level. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to:
- Provide truthful, accurate registration information
- Keep your password secure and not share it with others
- Notify us immediately if you suspect unauthorized access to your account
- Not create more than one account per person without our written permission
- Not use another person's account without authorization
We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.
5. Parental Consent & Minor Users
If a student is under 18, a parent or guardian account must be linked to the student account before full service access is granted. By creating or approving a student account, the parent or guardian:
- Confirms they are the student's legal parent or guardian
- Agrees to these Terms on behalf of the minor
- Consents to the collection and use of the minor's information as described in our Privacy Policy
- Accepts responsibility for the minor's compliance with these Terms
- Acknowledges that separate consent is required for AI-powered adaptive features (see Section 10)
Parent rights: Parents and guardians may at any time review their child's account information, request corrections, or request deletion by contacting privacy@ocstudy.com. Identity verification may be required before changes are made.
A parent or guardian account cannot be removed from a minor student's profile by the student. Parental oversight remains in place until the student turns 18 or until the account is closed.
6. Billing & Subscriptions
Subscription plans
OC Study offers subscription-based access to the Service on a monthly or annual basis. Prices are displayed at the time of purchase and may be subject to applicable taxes. All fees are charged in U.S. dollars.
Automatic renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis without requiring additional approval for each renewal.
Payment
You must provide a valid payment method. You authorize us to charge all fees to that payment method. If a payment fails, we may suspend access to the Service until payment is resolved. You are responsible for any applicable returned payment or bank fees.
Price changes
We reserve the right to change subscription pricing. We will notify you at least 30 days in advance of any price increase. Continued use of the Service after a price change constitutes acceptance of the new pricing.
7. Cancellation & Refunds
Cancellation
You may cancel your subscription at any time through your account dashboard or by contacting support@ocstudy.com. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date.
Refunds
Refund requests made within 3 days of your initial subscription purchase will receive a full refund. After the 3-day window, subscription fees are non-refundable, including for partial billing periods. This policy does not affect any statutory rights you may have under applicable law.
Note: Cancelling your subscription does not automatically delete your account or your data. To request account or data deletion, contact us separately at privacy@ocstudy.com.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Share your account credentials or allow others to access your account
- Reproduce, distribute, or resell any content from the Service without written permission
- Use automated tools, scrapers, or bots to extract data from the platform
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Upload or transmit harmful, offensive, or unlawful content
- Impersonate another person, student, or parent/guardian
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for any commercial purpose not expressly authorized by us
Violation of these rules may result in immediate termination of your account without refund.
9. Intellectual Property
All content on OC Study — including but not limited to practice questions, explanations, study plans, software, text, graphics, and design — is owned by or licensed to OC Study and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational purposes. This license does not permit you to copy, modify, distribute, sell, or create derivative works based on our content without prior written consent.
Any feedback or suggestions you submit to us may be used by us freely without any obligation to you.
10. AI-Powered Features
OC Study uses artificial intelligence and machine learning to personalize study plans, identify skill gaps, and predict score ranges. These features rely on the analysis of your performance data over time.
For users under 18, AI-powered adaptive features require explicit parental or guardian consent, separate from general account registration. Parents can enable or disable AI features at any time through their account settings or by contacting us.
AI-generated recommendations are intended as educational guidance only. They do not constitute professional academic counseling, and we make no guarantees about specific score outcomes or college admission results.
We do not use student data to train commercial AI models for third-party sale or advertising purposes.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
We do not guarantee any specific score improvement, academic outcome, or college admission result from use of the Service. Outcomes depend on many individual factors outside our control.
We reserve the right to correct any errors or inaccuracies in the content of the Service at any time, including after a question or explanation has been accessed by a user.
12. Limitation of Liability
To the maximum extent permitted by applicable law, OC Study and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service — including loss of data, loss of profits, or personal injury — even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim or (b) $50 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages. If you reside in such a jurisdiction, the limitations above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless OC Study and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violations of these Terms. If we terminate your account without cause, we will refund any prepaid unused subscription fees on a pro-rated basis.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination — including Sections 9, 11, 12, 13, and 15 — will survive.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising under these Terms that cannot be resolved informally will be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened misappropriation or infringement of intellectual property rights.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
We encourage you to review these Terms periodically. The date at the top of this page indicates when these Terms were last updated.
17. General Provisions
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions will continue in full force and effect. The class action waiver in Section 15 is severable from the arbitration clause; if the waiver is found unenforceable in a particular dispute, that dispute may proceed in court but not as a class action.
Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, acts of government, power failures, internet outages, or third-party service disruptions. For the avoidance of doubt, data breaches and cybersecurity incidents are not force majeure events and are governed solely by our Privacy Policy and applicable data protection laws.
Statute of Limitations
Any claim or cause of action arising from or relating to these Terms or the Service must be filed within one (1) year after the claim or cause of action arose. Claims filed after this period are permanently barred, regardless of any applicable statute of limitations. This limitation does not apply to claims by us to enforce payment obligations or intellectual property rights.
Assignment
You may not assign, transfer, or sublicense these Terms or any of your rights or obligations hereunder without our prior written consent. We may assign these Terms — including any rights to student or user data — only in connection with a merger, acquisition, or sale of all or substantially all of our assets, provided that the acquiring entity agrees in writing to be bound by these Terms and our Privacy Policy. We will notify users before any such assignment takes effect, and users who are parents or guardians of minors will have the opportunity to delete their child's account and data if they object.
Electronic Communications
By creating an account, you consent to receive communications from us electronically, including emails and in-app notices. You agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing. For users who are parents or guardians of children under 13, this consent is provided on behalf of yourself and constitutes the affirmative acknowledgment required under the COPPA Rule amendments effective June 2025.
Accessibility
We are committed to making our Service accessible to users with disabilities. We aim for conformance with WCAG 2.1 Level AA accessibility standards. If you encounter accessibility barriers, please contact us at support@ocstudy.com and we will make reasonable efforts to accommodate your needs.
No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any term or condition must be made in writing and signed by an authorized representative of OC Study.
Entire Agreement
These Terms, together with our Privacy Policy and any additional terms you agree to in connection with specific features or services, constitute the entire agreement between you and OC Study regarding the Service and supersede all prior agreements, communications, or representations.
